These terms apply when you buy products from bensturgeondesign.com. Please read them before placing an order. By placing an order, you agree to these terms.
1. About us
Ben Sturgeon Design is a trading name for Apple Tree Group Ltd, a company registered in England and Wales (company number 13814639). Registered office: Donington, Spalding, Lincolnshire, PE11 4. Email: ben.sturgeon.design@gmail.com.
2. Our products
- Most of our products are 3D printed to order, so each one is made individually and may differ slightly from the images shown. This is a natural part of the design and manufacture process and differences are minimised as much as possible.
- Minor layer lines and small variations in colour or finish are a normal part of 3D printing and are not a fault. Colours shown on devices will vary.
- Product photos are as accurate as possible, but colours can look different on different screens.
- Sizes and measurements are approximate but adhered to as much as possible with small margins of error.
- Some products contain small parts and are not suitable for children under 3 years old. Please read the product description and any safety warnings before buying.
3. Placing an order
When you place an order, we will email you to confirm we have received it.
We may refuse an order, for example if an item is unavailable, a price was clearly wrong, or we cannot deliver to your address. If we do, we will tell you and refund any payment in full.
4. Personalised and custom orders
For personalised or custom orders, please check your text, sizes and options carefully before ordering. We will make the item exactly as you specify, so we cannot accept changes once production has started. We may refuse personalisation that is offensive or infringes someone else’s rights, such as trade marks or copyright.
5. Prices and payment
- All prices are in pounds sterling (£) and your individual banking group or financial services provider will apply any additional charges required to convert currency from GBP.
- Delivery charges are shown at checkout before you pay.
- Payment is taken when you place your order, through our secure payment provider, Tapp please check their privacy policy for further information on how they manage your personal data.
- If we find a pricing error, we will contact you before dispatch and you can choose to continue at the correct price or cancel for a full refund.
6. Delivery
Delivery costs and times are set out in our Delivery Policy. Your order is our responsibility until it is dispatched from us.
7. Your right to cancel
If you are a consumer, you can cancel your order and return most items within 30 days of receiving them. This does not apply to personalised or custom made items unless they are faulty. Full details are in our Returns and Refunds Policy.
8. Faulty items and your legal rights
We are required by law to supply goods that are of satisfactory quality, fit for purpose and as described. If an item is faulty, please contact us and we will repair, replace or refund it in line with the Consumer Rights Act 2015. 9. Our responsibility to you
If we fail to meet these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our failure. We are not responsible for loss or damage that is not foreseeable, or for business losses, as our products are for domestic and private use.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under English law however it is your responsibility to use our products safely in accordance with the guidance provided on the listing. Nothing in these terms affects your statutory rights.
10. Events outside our control
We are not responsible for delays caused by events outside our control, such as postal strikes or severe weather. If this happens, we will contact you as soon as possible. If the delay is likely to be significant, you can cancel your order for a full refund.
11. Intellectual property
All content on this website, including product designs, photos and text, belongs to Ben Sturgeon Design or is used with permission. Some designs are made under commercial licence from their original designers. You may not copy or reuse our content without permission.
12. Your personal data
We use your personal data as described in our Privacy Policy.
13. Complaints
If you have an issue, please email ben.sturgeon.design@gmail.com and we will do our best to resolve it quickly. If we cannot resolve it.
14. Changes to these terms
We may update these terms from time to time. The terms that apply to your order are the ones shown on our website when you placed it.
15. Law and jurisdiction
These terms are governed by the Law of England and Wales.
